Dans le domaine de la justice pénale, l’enquête est au cœur des pratiques professionnelles. Nos données résultent d’une recherche menée au sein de trois services de probation de Suisse latine, et portant sur la dynamique de sécurisation de l’action. En nous basant sur le paradigme indiciaire de Ginzburg et la théorie pragmatiste de l’enquête de Dewey, nous identifions quatre situations d’enquête dans l’activité professionnelle des agents de probation. Nous montrons que, malgré l’orientation toujours plus présente d’une rationalité actuarielle et gestionnaire, la pratique des agents de probation reste largement orientée par une clinique de la vigilance adossée à la démarche de l’enquête. Nous argumentons en faveur de l’articulation de ces deux démarches dans une culture de sécurité.
In the field of criminal justice, investigation is at the heart of professional practice. Our data come from research carried out in three probation services in Latin Switzerland on the dynamics of securitisation of action. Based on Ginzburg’s indexical paradigm and Dewey’s pragmatist theory of enquiry, we identify four situations of enquiry in the professional activity of probation officers. We show that, despite the increasing orientation towards an actuarial and managerial rationality, the practice of probation officers is still largely oriented by clinical practices of vigilance based on an investigative approach. We argue for the articulation of these two approaches in a culture of safety.
Im Bereich des Strafrechts stellt die Ermittlung das Herzstück der professionellen Praxis dar. Unsere Daten resultieren aus einer Studie, die innerhalb von drei Bewährungshilfeeinrichtungen in der romanischen Schweiz zur Dynamik der Absicherung des Handelns durchgeführt. Basierend auf dem Indizienparadigma von Ginzburg und der Theorie des Pragmatismus von Dewey identifizieren wir vier Ermittlungssituationen in der beruflichen Tätigkeit von Bewährungshelfern. Wir zeigen, dass, trotz einer zunehmenden Orientierung an einer wirtschaftlichen und administrativen Rationalität, die Praxis der Bewährungshelfer weiterhin weitgehend an einer klinisch geprägten Aufmerksamkeit, welche sich an den Gang der Ermittlung anlehnt, orientiert ist. Wir argumentieren für eine Verknüpfung der beiden Wege in der Sicherheitskultur.
